In Ecuador, by means of Executive Decree 1700-A, published in Official Gazette Number 357 on June 16, 2004, the country adhered to the “XII Hague International Convention Abolishing the Legalization of Foreign Public Documents”(Hague Apostille Convention), signed in The Hague, The Netherlands, on October 5, 1961.
The main objective of the convention is precisely to exonerate, suppress or “…abolish the requirement of diplomatic or consular legalization for foreign public documents…”(Text of the convention).
Ecuadorian consulates do NOT apostille documents, as people mistakenly think.
Exit Permitsfrom the Country
The law in Ecuador establishes that Ecuadorian and foreign children and adolescents residing in Ecuador who need to travel outside the country must have their parents’ authorization.
- In the event that they travel out of the country with one of their parents, they must have the authorization of the other parent.
- If they travel alone or with third parties, they require the authorization of both parents, unless one of them is deprived of parental authority; or, failing that, with the authorization of a judge.
When traveling alone or in the company of third parties, the departure authorization must state:
- The reason for the trip.
- The time they will remain out of the country.
- The precise place of residence abroad.
If the departure is for a period of more than six months, the authority that issued the authorization must immediately inform the Ministry of Foreign Affairs, which will permanently monitor the location, activities and general condition of children and adolescents who have left the country under these conditions.
Authorization is not required when traveling in the company of both parents or if one of them has the authorization of the other in a public and duly authenticated document, in case it was granted in a foreign country.
The authorization is granted before a Notary Public, as a general rule. In case of refusal, absence or incapacity of one of the parents, the other parent may request it before a judge, who will grant it.
