Homologation in Ecuador<\/strong> is the recognition of a foreign judgment<\/strong>. It is the validation in Ecuador<\/strong> of a sentence issued outside the country<\/strong>. It is the nationalization of a foreign judgment<\/strong>.<\/p>\n

Example: A sentence issued by judges in the United States, Spain, Italy<\/strong>, etc., and which must be recognized and executed by the Ecuadorian State<\/strong>, must first be homologated<\/strong> or what is equivalent to say recognized by the Judicial Function<\/strong>. Only in this way will<\/strong> the judgment have extraterritorial effect<\/strong>.<\/p>\n

It is not admissible in International Law<\/strong> for a foreign judgment<\/strong> to produce its legal effects directly in another country, it is necessary to comply with the homologation process<\/strong>.<\/p>\n

The first thing that must be done with the foreign judgment<\/strong> is to legalize it through the apostille<\/strong>, in order for it to have full legal effects in Ecuador<\/strong>.<\/p>\n

This is the first step<\/strong> that must be taken, not only with court rulings<\/strong>, but with all public or private documents or instruments<\/strong> that are intended to be enforced extraterritorially in another State, Nation or Country.<\/strong><\/p>\n

Documents executed in foreign territory<\/strong> must be authenticated<\/strong> in accordance with the Hague Apostille Convention<\/strong>.<\/p>\n

These issues, at present, are very important<\/strong> given the enormous migration of Ecuadorians abroad<\/strong>, there are real communities of Ecuadorians<\/strong> in Spain, Italy and the United States<\/strong>, who within their coexistence in foreign countries get married, get divorced, procreate children, as well as die.<\/strong><\/p>\n

The most common cases<\/strong> are divorces performed in foreign countries<\/strong> such as the United States and others.<\/strong> In such cases, whoever intends to enforce such divorce in Ecuador<\/strong>, must necessarily validate it<\/strong> or what is equivalent to say: homologate it<\/strong>. The homologation proceeds as long as all the requirements of legality are met<\/strong> and it is not contrary to Ecuadorian public law<\/strong>.<\/p>\n

Ecuador has the power to recognize or not a divorce or remarriage<\/strong> of persons divorced abroad, in accordance with the S\u00e1nchez de Bustamante Code of Private International Law.<\/strong><\/p>\n

Finally, the evidentiary effects of a judgment have no effect in the Ecuadorian legal system<\/strong> if it is not previously homologated.<\/p>\n

Several international conventions, treaties and the Code of Private International Law<\/strong> are applied in the homologation of foreign judgments in Ecuador<\/strong>.<\/p>\n

It must be a highly qualified and experienced professional<\/strong> who sponsors the homologation of a foreign judgment in Ecuador<\/strong>.<\/p>\n

In short, the homologation<\/strong> must comply with supranational, constitutional and legal requirements<\/strong> in order to be validated in Ecuador or any other country.<\/strong><\/p>\n
